Article 0 – Preamble
The present General Conditions of Sale of the site www.iume-france.com
apply exclusively between the company LEMI and any customer (hereinafter “Customer”) of the www.iume-france.com site making a purchase via the Site.
Iumé, is a brand of creation of candle and perfume created by the company LEMI SAS.
The Terms and Conditions define the rights and obligations of the parties in connection with the sale of products on the Site.
The GSC are the only ones applicable and replace all other conditions, except contrary agreement preliminary, express and written of the company LEMI.
At any time, LEMI reserves the right to adapt or modify certain points of the GTC. Consequently, it is necessary to take note of the version in force the day of the placing of the order on the Site. These adaptations or modifications are opposable to the user as of their on line and will be applicable to the orders placed after their on line.
Article 1 – Customer Account
Any user of the Site www.iume-france.com has the possibility to open an account which contains the personal information concerning him. Any order placed on the Site requires the creation by the Customer of an account. Access to this account is protected by an identifier and a password. When opening the account, the Customer acknowledges having read and accepted the GTC by checking the box provided for this purpose.
The Customer will be bound by any order placed from his account. It is therefore the responsibility of the Customer to protect the confidentiality of his username and password. LEMI reserves the right to suspend or terminate the account of a Client who contravenes the stipulations of the GTC, as well as the legal and regulatory provisions in force in France.
Article 2 – Contract
The contract is deemed to be concluded between the parties at the time of acceptance of the payment of an order by LEMI. The acceptance of the payment of an order will vary according to the method of payment chosen by the Customer.
In order to fight against fraudulent orders by credit card, LEMI reserves the right to ask the customer for a voucher (ID, proof of address …) to validate the shipment of the order. In case of non-receipt of the requested voucher within 48 hours, LEMI reserves the right to cancel the order of the customer and therefore to refund it.
The acceptance of the payment of an order by LEMI implies the acceptance by the Customer of the GSC in force on the date of the placing of the order.
The contract is valid until the execution of the Customer’s order.
By accepting these Terms and Conditions, the Customer declares that he has the legal capacity to enter into a contract in accordance with Article 1123 et seq. Of the Civil Code.
Article 3 – Products
Products displayed on the site are available for sale. LEMI provides the Customer with a descriptive sheet and snapshots of the products offered for sale. The photos of the products are not contractual. The products are offered for sale for a specified period. LEMI reserves the right to change the duration of sale of the products offered without liability.LEMI reserves the right to decide on the availability of the products according to the place of delivery (Corsica, Belgium, islands …)
Article 4 – Product Availability
Product offers are valid as long as they are visible on the Site. Upon acceptance of an order, a purchase confirmation email will be sent by LEMI to the Customer who placed an order summarizing the products ordered.
Only the receipt of the purchase confirmation email by LEMI guarantees the availability of the product.
However, after placing the order, LEMI reserves the right to suspend the sale of a product in case of unavailability. In this event, LEMI will inform the Customer as soon as possible by email or telephone and offer the Customer either to cancel the order or another substantially identical item. In case of cancellation by the Customer of his order, LEMI will refund (by check, by refund on the credit card used or by paypal) the amount paid by the Customer when ordering within a maximum of fourteen (14) days from the Customer’s decision.
Article 5 – Terms of order and prices
Orders are exclusively placed on the Site. Any other form of order will not be accepted unless expressly agreed in writing by LEMI.
During the validation of the contents of his basket, the Customer will be redirected to a window allowing him to access his account in order to continue placing the order or allowing him to open a customer account for the purpose of continuing the ordering process.
Any order can be registered on the Site only if the Customer is clearly identified by the entry of his username and password which are strictly personal. Any order placed using an identifier and password will be considered validly issued.
Any order will be accepted by LEMI only at the time of the recording of the payment by the Customer of his order.
Any order accepted by LEMI will send the Customer to the email address used to place the order for a purchase confirmation email summarizing the products ordered and the delivery address. It is the responsibility of the Customer to ensure that the confirmation email sent by LEMI is not blocked by an email filtering device. LEMI can not be held responsible for blocking or erasing the purchase confirmation email regardless of the device involved.
Only the confirmation email confirms the Customer’s availability of the ordered product, subject to Article 4 above.LEMI reserves the right to cancel an order in the event that the Customer commits fraudulent means of payment or any other criminal offense.
The prices displayed in euros on the Site are the prices inclusive of all taxes and take into account the VAT rate applicable on the day of the order.
Despite the care taken by LEMI, the prices displayed on the Site may contain errors. In this event, LEMI can not be held responsible for such errors and LEMI reserves the right to cancel any order when such errors occur.
It is possible that the Customer’s payment currency differs from the currency in which the prices are displayed. In the event that the Client’s banking establishment applies an exchange rate to the transaction between the Client and LEMI, the Customer will exclusively bear the exchange fees applied by his bank.
Due to an adapted commercial policy and various constraints (logistics …), LEMI reserves the right to sell a product at a different price depending on the country of delivery of the order.
5.3 Price change
LEMI reserves the right to change without notice the prices of the products of the section “to come” and / or “for sale” in the event of a change in the applicable VAT rate, in case of fluctuation of raw material costs or for any other reason.
The price applicable to a product is the price appearing on the Site at the time of the order.

The payment of the products is done by credit card. LEMI can not be held responsible for losses and any damage resulting from any attempt to pay by a means of payment other than those mentioned in the GTC.
The price to pay is the one indicated on the Site at the time of purchase. It corresponds to the cumulation of the prices of the products ordered. This final price will be indicated to the Customer at the “order verification” step, before payment of the order.
In accordance with Article 4 above, LEMI reminds that any sale is concluded under the condition precedent of the availability of the product and receipt of a confirmation sent by LEMI to the Customer.
Article 7 – Securing payments
LEMI has made the choice to secure the online payment as much as possible by using STRIPE as a credit card payment method. The Customer can also use Paypal. Only SSL e-transactions have access to confidential data that the Customer provides at the time of online payment.LEMI does not have access to this data, so it will be requested from the Customer for each order.
Article 8 – Delivery
For any order confirmed and settled, the preparation of the order and its shipment take place within 2 working days of receipt of payment, plus the delivery time from 48 to 72H. The deadlines are given in working days (excluding weekends and holidays) and as an indication by La Poste.
The order will be delivered to the address indicated by the Customer when registering on the Site or placing the order (for delivery to a different address, the fields of the delivery address must be completed).
In the event that the Customer wishes to change the delivery address after placing his order, it must send as soon as possible an email to customer service at the following address: firstname.lastname@example.org by reminding the number of the order, the product concerned and specifying the new delivery address.LEMI will then send, according to the progress of the Customer’s order, a confirmation email authorizing or refusing the modification of the delivery address. Any additional costs and additional costs generated by the modification of the delivery address will be the sole responsibility of the Customer. LEMI reserves the right to accept or refuse the request to change the delivery address.
In case of damage (damaged product), the Customer MUST refuse the product delivered at the time of delivery and confirm its reserves within three (3) working days following the date of delivery by email to email@example.com In case of refusal of a product, return shipping costs will be the sole responsibility of the customer.
Article 9 – Right of withdrawal
In accordance with the legal provisions in force, the Customer has a delay from the order and up to fourteen (14) working days after the day of the delivery of the products to exercise his right of withdrawal from LEMI without having to justify reasons or to pay penalties.
In case of exercise of the right of withdrawal, the Customer must first inform LEMI by email at the following address: firstname.lastname@example.org. The email thus sent will constitute the date of effective exercise of the Customer’s right of withdrawal.
In order to allow the return of the product under the best conditions, LEMI will be in charge of selecting the mode of transport, as well as the identity of the carrier. The Customer expressly waives the right to reship any product without consulting LEMI in advance.
In case of exercise of this right of withdrawal within the period referred to above, only the price of the returned product and the delivery costs indicated in the order will be refunded. The costs and risks of return will remain the sole responsibility of the Customer.
All product returns under this article must be made in the original and complete state of the product (packaging, accessories, manuals, etc.) so as to allow its resale. A copy of the sales invoice or order confirmation must also be returned with the product.
Any returned product must be sent to the address indicated by LEMI.
Any product returned incomplete or used will not be taken back under the right of retraction.
Any refund under this article will be made by check, refund on credit card or Paypal within fourteen (14) days of the date on which the returned product is received by LEMI.
In case of cancellation of orders, the fees charged at the time of the order related to the use of the paypal account and the delivery costs will not be refunded.
Article 10 – Copyright and reproduction rights
The entire site is covered by French and international legislation on copyright, image rights and intellectual property. All rights of reproduction are reserved. The total or partial reproduction of the elements of this site (photos, images, texts .., whatever the medium, is formally prohibited except express written authorization provided by their (their) owner (S).

The Customer is responsible for the capture and truth of any information at each stage of his order, as well as at all stages after the conclusion of the contract.
LEMI can not be responsible for the information provided by the Customer at each step of his order, as well as at all stages after the conclusion of the contract.LEMI does not guarantee the acceptance of the Customer’s order and disclaims all liability in the event of unavailability of the ordered product, subject to reimbursement to the Customer of the price of the product ordered.LEMI ‘s sole liability under the Contract is that set forth in Section 11 above. LEMI will not incur any liability for any indirect, special and consequential damages as a result of the contract.LEMI ‘s liability can not be engaged in the event that the non – performance of its obligations is attributable to the unforeseeable or insurmountable event of a third party to the contract, or to a case of force majeure as defined by the French jurisprudence or to a fact beyond the control of LEMI.LEMI ‘s liability can not be held liable for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or the presence of computer viruses.LEMI ‘s obligation under the contract is an obligation of means limited to the processing of orders.
Article 13 – Applicable law
These Terms are subject to French law. In case of dispute, the French courts will be competent. Regulation (EU) N ° 524/2103 named One Line Dispute Resolution (ODR) is an independent, impartial, transparent, effective, timely and fair extrajudicial procedure for the settlement of disputes arising from the online sale of goods or services between the different EU countries: http://ec.europa.eu/consumers/odr (the online dispute resolution platform).
Article 14 – Dispute Resolution
The court of competent jurisdiction in case of dispute will be that of the place of residence of the defendant or, at the choice of the plaintiff, the place of actual delivery of the product.
Article 15 – Evidence
The computerized registers, preserved in the computer systems of LEMI and, if necessary, its partners under reasonable conditions of safety, will be considered as proof of the communications, the orders and the payments made between the parts, without prejudice of the possibility for the Customer to prove the contrary by any legally recognized means.

Article 17 – Severability
Any stipulation of the GTC prohibited by or deemed to be unlawful or unenforceable in accordance with the applicable laws and applied by any court of competent jurisdiction shall, within the limits required by law, be withdrawn from the contractual agreement concerned and to the extent possible declared without effect, without modifying the remaining stipulations. The invalidity of all or part of the provisions of the GTC must not in any way nullify or affect the validity of any other stipulation and does not exonerate the Customer from the performance of its obligations.
